Terms of Service for Strange Adventures

These Terms of Service (hereinafter, the "Agreement") constitute a legally binding agreement between you (hereinafter, "you," "your," or "User") and Strange Adventures, an Arizona-based retail entity (hereinafter, "Strange Adventures," "we," "us," or "our"), governing your access to and use of all websites, applications, products, services, and retail operations operated by Strange Adventures (collectively, the "Services").

By accessing or using the Services, or by clicking “I Agree,” submitting an order, or otherwise indicating acceptance, you expressly acknowledge and affirm that you have read, understood, and agree to be legally bound by the terms and conditions set forth herein.

1. Eligibility

Access to and use of the Services is limited to individuals who are at least eighteen (18) years of age or the age of majority in their jurisdiction, whichever is greater. If you are under the age of majority, you may only access the Services with the express consent and ongoing supervision of a parent or legal guardian, who shall be deemed the contracting party.

2. Prohibition of Automated Processes and Bot Activity

You hereby agree that the deployment or utilization of any automated means, including but not limited to web crawlers, bots, scripts, macros, proxy routing, VPN anonymization, or browser automation technologies (e.g., Selenium, Puppeteer), for the purpose of engaging with or manipulating the Services, is strictly prohibited. Strange Adventures in its sole discretion will determine if bot activity has deployed or utilized.

Any attempt to subvert or circumvent security protocols, purchasing limits, checkout systems, or product availability mechanisms by automated or deceptive means shall constitute a material breach of this Agreement and will result in, without limitation, order cancellation, denial of service, forfeiture of funds, permanent banning, and/or legal action.

We reserve the unrestricted right to monitor and record access patterns, browser sessions, IP addresses, device fingerprints, and behavioral telemetry to detect such violations.

3. Binding Digital Acknowledgment (Anti-Bot Affirmation)

As a condition precedent to completing any transaction, Users shall be required to affirmatively acknowledge, via interactive checkbox or equivalent user interface element, that no automated processes or agents are being employed in the execution of said transaction.

Said acknowledgment shall be permanently associated with the order record and will be submitted as evidentiary material in any chargeback dispute, litigation, or third-party payment resolution proceeding.

4. Right of Refusal, Cancellation, and Restriction

Strange Adventures reserves the unilateral and discretionary right to review, hold, modify, reject, or cancel any order for any reason, including but not limited to suspected fraud, violation of purchasing restrictions, bot activity, or misuse of the Services.

No order shall be deemed accepted until such time as it is processed, confirmed, and physically shipped. The mere issuance of a confirmation email shall not constitute acceptance.

5. Sales Finality, Refund Exclusions, and Ineligibility

All sales effectuated through the Services are considered final and irrevocable unless expressly stated otherwise in the specific product listing or where required by statutory consumer protections.

Refunds and returns shall not be granted for:

• Orders originating from bot activity or automated processes;
• Transactions in breach of item limits or this Agreement;
• Orders flagged for fraud, risk, or manipulation;
• Purchases made for unauthorized commercial resale.

6. Chargeback Policy and Enforcement Mechanisms

By entering into this Agreement, you expressly waive any right to initiate a chargeback inconsistent with these Terms. Any chargeback initiated without substantive legal basis or in bad faith shall constitute a breach of contract.

In the event of a disputed payment, Strange Adventures reserves the right to provide any or all of the following to the financial institution or payment processor:

• IP logs and device-level data;
• Time-stamped checkout confirmations;
• Anti-bot affirmations and transaction metadata;
• This Agreement in its then-current form.

Unwarranted chargebacks may result in suspension, permanent blacklisting, and pursuit of civil damages.

7. Customer Support Limitations for Flagged Transactions

Strange Adventures is under no obligation to provide customer support, including but not limited to inquiries regarding shipping, tracking, refunds, or general assistance, for any order deemed by us to be in violation of this Agreement.

Users associated with flagged transactions may be denied further communication or interaction with our team.

8. High-Demand Product Releases and Allocation Policies

For pre-orders, exclusive items, and limited-quantity releases:

• Purchase caps may be imposed and strictly enforced per individual, household, or payment method;
• Multiple orders determined to be originating from the same source may be summarily canceled;
• Carting or adding to a virtual basket does not guarantee inventory allocation.

Inventory is not secured until a confirmation of shipment is issued.

9. Shipping, Force Majeure, and Fulfillment Delays

We shall not be held liable for delays arising from third-party carrier disruption, supplier issues, natural disasters, civil unrest, or any event reasonably considered force majeure.

Refunds may be granted only in cases of substantial delay, excluding any orders voided or held pursuant to Section 2 or Section 4 of this Agreement.

10. Amendments and Modifications

Strange Adventures reserves the right to revise, modify, or amend this Agreement at any time, with or without prior notice. It is the User’s responsibility to review the Terms periodically for any changes.

Continued use of the Services after such modifications shall constitute affirmative acceptance of the revised Terms.

11. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles.

Any dispute, controversy, or claim arising from or related to this Agreement shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona. You hereby irrevocably consent to personal jurisdiction and venue in such courts.

12. Severability and Waiver

If any provision of this Agreement is found by a court of competent jurisdiction to be unenforceable, the remaining provisions shall remain in full force and effect.

No waiver of any breach or default hereunder shall be deemed a waiver of any preceding or subsequent breach or default.

13. Entire Agreement

This Agreement, together with our Privacy Policy and any supplementary notices or product-specific terms, constitutes the entire understanding between you and Strange Adventures concerning the Services and supersedes all prior agreements.

By accessing or utilizing the Services in any manner, you affirmatively consent to be bound by this Agreement in its entirety.
